Terms of Service
These Terms of Service ("Terms") govern your use of openbyo.ai and its subdomains, including the early-access and integration forms and sign-in with Google (the "Service"), operated byopenbyo.ai ("openbyo.ai", "we", "us"). By using the Service you agree to these Terms and to ourPrivacy Policy. If you do not agree, do not use the Service.
1. The Service
openbyo.ai lets people use their own AI provider accounts in the apps they choose, and lets developers integrate with it. The Service is in early access: features may be incomplete, change or be withdrawn, and access is granted by invitation at our discretion. Signing in or joining the list does not guarantee access.
2. Eligibility
You must be at least 16 years old and able to form a binding contract. If you use the Service for an organization, you confirm you are authorized to accept these Terms for it, and "you" includes that organization.
3. Accounts and Google sign-in
You sign in with your Google account; your use of Google is governed by Google's own terms. You are responsible for activity under your account and for keeping it secure, and must give accurate information. Tell us at support@openbyo.ai if you suspect unauthorized use.
4. Acceptable use
You agree not to:
- break any law, or infringe or misappropriate anyone's rights;
- probe, scan or test the Service's security, or circumvent any access control or rate limit, except under a written agreement with us;
- interfere with or overload the Service, or introduce malware;
- scrape, copy or resell the Service, or use it to build a competing product;
- submit false information or someone else's details, or impersonate any person; or
- use the Service to send spam or to harass or harm anyone.
5. Third-party AI providers and services
The Service works with AI providers and apps we do not control. Your use of them is governed by their terms, and you are responsible for any charges and for complying with their policies. We are not responsible for their availability, output or conduct. openbyo.ai is an independent service. It is not affiliated with, sponsored by, or endorsed by OpenAI, Anthropic, Google or any other AI provider. Product names and logos are used to indicate the supported AI providers.
6. Intellectual property
The Service, including its software, design, text and logos, belongs to openbyo.ai or its licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service under these Terms. You keep all rights in the information you submit and grant us the right to use it to provide and improve the Service, as described in the Privacy Policy.
7. Feedback
If you send us suggestions or feedback, we may use them without restriction or obligation to you.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OPENBYO.AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AND US$100. Some jurisdictions do not allow these limits, so they may not fully apply to you.
10. Indemnity
You will defend and indemnify openbyo.ai against claims, damages and costs (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Service.
11. Suspension and termination
You may stop using the Service at any time and ask us to delete your information. We may suspend or end your access at any time, including if you breach these Terms. Sections 6 to 12 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state and federal courts located in Delaware, and you and we consent to their jurisdiction. Nothing here limits rights you have under the mandatory consumer laws of where you live.
13. Changes to these Terms
We may update these Terms. We will post the new version here with a new "Last updated" date and, for material changes, give notice by email or on the site. Continuing to use the Service after the changes take effect means you accept them.
14. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part is unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. You may not assign these Terms without our consent; we may assign them in a merger, acquisition or sale of assets.
